What Is Administration?

Administration, in its shortest definition, is the name given to public institutions and organisations. With this scope, all institutions of the state; ministries, municipalities, universities, hospitals, hospitals and similar public institutions and organisations can be called administration.

What Is Administrative Law?

Administrative law is a branch of law that covers all legal regulations made for the protection of individuals against public power and authority, determines the legal limits of the transactions and actions of the administration, and sanctions the transactions and actions of the administration outside the area permitted by law and the compensation or elimination of the damages arising from them by the administration.

As such, administrative law covers many areas of law, from Misdemeanour Law to Energy Law, from Administrative Trial Law to Zoning Law, and since the illegality of administrative acts and actions is directly evaluated within the scope of this law, it is associated with many other areas of law.

What is Administrative Litigation?

According to Article 125 of the Constitution of the Republic of Turkey, the judicial remedy is open against all kinds of actions and proceedings of the administration. The subject of administrative proceedings are administrative actions, damages arising from administrative actions or disputes arising from administrative contracts. Accordingly, the cases before administrative courts are grouped as cancellation cases, full judicial cases and cases arising from administrative contracts. The Law No. 2577 on Administrative Procedure shows the types of administrative lawsuits in this way.

What are the Administrative Jurisdiction Courts?

In Turkey, there are three Courts in the administrative judicial branch. These are the Council of State, Regional Administrative Courts and Administrative or Tax Courts. Administrative or Tax Courts have the status of local courts, while Regional Administrative Courts are appellate courts and the Council of State is an appeal court.

What Is The Time Limit For Filing A Lawsuit In Administrative Courts In Turkey?

The time limit for filing a lawsuit is sixty days in the Council of State and administrative courts and thirty days in tax courts, unless a separate period is specified in special laws. However, the relevant person may first apply to the administration within this period instead of filing a lawsuit. In this case, if the administration does not respond within 30 days, this application is deemed rejected. The period for filing a lawsuit starts with the rejection of the application or the expiry of this 30-day period.
