How Do Intellectual and Industrial Property Laws Differ in Turkey?

In Turkish Law, trademarks, patents, designs, geographical indications and utility models are explicitly listed under the Industrial Property Law No. 6769. On the other hand, the protection of Intellectual Property Law No. 5846 is aimed at scientific, literary or artistic works that reflect the subjectivity of the owner, which is directly expressed by the concept of work.
In Article 1/B/1-a of the Intellectual Property Law, work is defined as “…All kinds of intellectual and artistic products that bear the characteristics of their owner and are considered as works of science and literature, music, fine arts or cinema…”. Accordingly, any product ranging from a person’s letters to scientific articles, from sculptures to cinema films may be within the scope of the work. On the other hand, the definitions and characteristics of the rights subject to industrial property are clearly indicated in the Law. Again, while intellectual property rights arise with the creation of the work and are subject to legal protection, industrial property rights arise only upon registration and benefit from legal protection.
What Is Copyright?
Copyright is the name given to the rights that the author has on his work. In accordance with Turkish Law the protection of copyright does not depend on registration, and the author becomes within the scope of protection with the emergence of the work. It needs to be noted that computer programmes also benefit from copyright protection in Turkey.
Copyright protection is 70 years from the death of the author in Turkish Law and the protection covers the moral and material rights of the author.
What Is Work Under Turkish IP Law?
Intellectual and artistic products that bear the characteristics of their owner and are counted as works of science and literature, music, fine arts or cinema are defined as works. Intellectual and artistic products which are created by making use of another work, but which are not independent from this work and which bear the characteristics of the person or persons who created it, are called adaptation works; works such as encyclopaedias and anthologies, the content of which consists of selections and arrangements and which are the result of a creativity of thought, provided that the rights on the original work are reserved, are called compilation works.
Who Is The Author?
The author of the work is, of course, primarily the real person who created the work. If more than one person participated in the creation of the work, these persons are joint owners of the work. The owner of a processing or compilation is the person who processes it, without prejudice to the rights of the original author. In cinema works; the director, the composer of original music and the script writer are the joint owners of the work. In addition, the animator is also counted among the authors in cartoons. According to Turkish Law, legal entities cannot be authors, but they can be the owners of the financial rights on a work.
What Are The Rights Of The Author Under Turkish Law?
In Turkish law, the rights of the author are in two groups: financial rights and moral rights. Moral rights are rights such as the right to specify the name on the work, the right to make the work public, the right to prohibit changes to the work. Financial rights, on the other hand, are a group of rights such as the right of processing, the right of reproduction, the right of dissemination, the right of representation, the right of transmission to the public, the right to share and the right of follow-up, which are the rights to benefit economically from the work.
What Are the Common Types Of Contracts in the IP Law Area?
